📑 Returns & Refunds Policy (RRK Street Wear — South Africa)

1. Voluntary Change-of-Mind Returns (Our Goodwill Policy)

We want you to be stoked with your gear. If you change your mind, you may return unused, unwashed, and undamaged hoodies, T-shirts, caps, shorts, pants, or shoes within 14 days of delivery.

• Returns are at your cost.
  
  
• Original shipping fees are non-refundable.
  
  
• Final-sale or clearance items are not returnable under this policy.
  
  
• Custom/personalised items (if offered in future) are excluded.
  
  

2. Your Statutory Rights (Non-Waivable)

These rights are guaranteed under the Consumer Protection Act (CPA) and the Electronic Communications and Transactions Act (ECTA):

• 7-Day Cooling-Off (ECTA):
  
   Cancel any online order within 7 days of delivery, for any reason. You pay the return shipping.
  
  
• 6-Month Implied Warranty (CPA):
  
  If your item is defective or not fit for purpose, you may choose repair, replacement, or refund within 6 months of delivery. We cover all costs, including collection.
  
  
• Repair Warranty (CPA):
  
  If we repair an item and it fails again within 3 months, you’re entitled to a replacement or refund — not another repair.
  
  
• Goods not as described / unsuitable (CPA):
  
  If you couldn’t inspect the goods before purchase (e.g., online), and they don’t match the description or fail a purpose you told us about, you may return them within 10 business days. We cover the cost. Note that colours on screen may slightly vary in real life. DTF print feel softens after a few washes.
  
  

3. Non-Returnable (Unless Defective)

• Worn, washed, or damaged apparel not caused by a defect.
  
  
• Gift cards and downloadable digital items.
  
  
• Customised/personalised products.
  
  

4. How to Return

1. Email rrkstreetwear@gmail.com with your order number and reason.
   
   
2. We’ll send you a Return Authorisation (RMA) and instructions.
   
   
3. Once we receive the item, we’ll process within 8-10 business days and issue your exchange, refund, or store credit.

2. Contract Formation

Orders are offers to buy. A contract is formed when we dispatch the goods and send confirmation.

3. Pricing & Errors

Prices shown for SA orders include VAT. We may cancel orders placed at an obvious pricing error, as permitted by law.

4. Delivery

Orders are executed within 20 days, unless agreed otherwise. Risk transfers on delivery to your nominated address; ownership transfers once we receive full payment.

5. Product Use

Our apparel is built for lifestyle and extreme sports culture. Use in high-risk activities is at your discretion. Nothing in these terms excludes liability we cannot exclude under law (e.g., CPA product liability).

6. Returns & Refunds

See our Returns & Refunds Policy above, which forms part of these Terms. Please note that some product image colours on the site are not true to offscreen real colours.

7. Limitation of Liability (Drawn to Your Attention)

To the fullest extent permitted by law, we’re not liable for indirect or consequential loss from your purchase or use. This does not exclude liability for:

• defective products under the CPA,
  
  
• death or injury caused by our gross negligence, or
  
  
• any liability that cannot be lawfully excluded.
  
  

8. Indemnity

You indemnify us against claims arising from your misuse of the products, except where caused by our negligence or where prohibited by law.

9. Intellectual Property

All RRK Street Wear names, logos, and designs are owned by RRK Street Wear (Pty) Ltd..

10. Disputes

If a complaint isn’t resolved, you may approach the Consumer Goods & Services Ombud (CGSO).

11. Governing Law

These terms are governed by South African law, with jurisdiction in the Western Cape Division.
